PRICES AND SHIPPING COSTS

All prices are net prices in Swiss francs (CHF), including VAT and, if applicable, advance recycling fees and copyrights. We reserve the right to change the prices, conditions and vintages indicated on our website, the reference day being the day of the order.

No claim of a later price adjustment or credit note can be taken into consideration. There are also local, regional and national promotions, discounts and reductions on articles and services in the stationary trade which cannot be offered identically online.

Delivery costs are charged as follows:

a) CHF 20.00 for orders of CHF 300.00 or less including VAT

b) CHF 0.00 for orders over CHF 300.00 including VAT

DELIVERY AND TRANSFER OF RISK

The seller limits the deliveries to the territory of Switzerland and the Principality of Liechtenstein. The delivery takes place directly to the delivery address and contact person given by the buyer.

The delivery takes place on condition that we ourselves have been supplied in good time and in good form by our suppliers. In case of force majeure such as strikes and other industrial actions, riots, war, natural disasters as well as in case of a stop of deliveries by the manufacturer or an upstream supplier, there is no delay of delivery. The seller does not assume any liability for delays in delivery caused by manufacturers or third parties.

If not all ordered goods are in stock, we are entitled to make partial deliveries. If, after conclusion of the contract, it becomes apparent that the goods cannot be delivered either in part or in full for reasons for which the seller is not responsible, the customer is entitled to withdraw from the contract.

Our performance consists of an obligation to deliver to our end customer

The delivery times mentioned in our online store and in our order acceptance confirmation according to section 2.3 are calculated from the date of our confirmation of receipt of payment.

IMPORTANT INFORMATION: We will send you the articles in packaging adapted to their fragility and thermal needs, it is important that you personally receive the package. If not, we advise you to indicate another delivery address (e.g.: your professional address).

Our deliveries will be made by the VINOLOG service of the Swiss Post, your order will be delivered within a period not exceeding 7 working days.

MANAGEMENT OF NON-CONFORMITIES

You are obliged, as soon as the normal course of business allows it, to check the delivered products and to inform our customer service without delay of any defects found at Contact@Misterchampagne.ch (for example by sending us photos if your products arrive damaged). If you fail to do so, the products are deemed accepted. Acceptance is in any case deemed to have taken place insofar as the customer has not communicated a complaint by e-mail to the customer service department within 8 days of delivery.

Defects that cannot be identified despite a proper inspection in accordance with the preceding paragraph must be communicated by e-mail to Contact@Misterchampagne.ch immediately after they are discovered, failing which the products ordered will also be deemed to have been accepted with regard to these defects.

The defective product shall be returned with a copy of the invoice and a detailed description of the defect(s). The return address will be communicated to the buyer by e-mail after receipt of his written complaint. The customer is responsible for any transport costs incurred.

We shall provide a warranty service by eliminating the defect(s), which shall take place, at our option, either by performing a secondary service, i.e. eliminating a defect (rework), or by delivering goods free of defects (replacement delivery). The replaced goods become the property of the seller.

If the secondary performance is not successful, the customer is entitled to withdraw from the contract. These provisions do not apply in case of minor defects. The customer's right to a price reduction is excluded. This exclusion of liability shall also apply to all claims arising from the contract (Art. 97 et seq. CO), from an unlawful act (Art. 41 et seq. CO), from a challenge to the contract on the grounds of error (Art. 23 et seq. CO), etc.

The warranty does not cover normal wear and tear or the consequences of improper handling or deterioration by the purchaser or third parties, as well as defects attributable to external circumstances.

- In particular, items that have been opened or damaged by the buyer are excluded from the warranty.

- Inappropriate storage or incorrect assessment of the degree of ripeness of a beverage (i.e. premature or late consumption) are not considered to be cases of application of the guarantee.

6.7. The customer does not receive any guarantees in the legal sense from the seller. Guarantees of the manufacture are not affected. The seller does not take any responsibility for descriptions written by third parties, especially customers, in the context of the online store, nor for customer comments published in our social network presences.

RIGHT OF RETURN

The customer has the right to return the delivered goods within 8 calendar days (from the date of delivery or acceptance). The return period shall be deemed to have been observed if the goods are handed over to the post office or another forwarding agency on the last day for dispatch.

The goods must be in their original packaging, complete with all accessories and accompanied by the completed delivery note/return note and any warranty card. Sealed products in their original packaging can only be returned if they have not been opened. Any seal must not have been broken.

The costs of returning items are assumed by Mister Champagne. Shipping costs and gift wrapping costs are not refunded. Coupons and special offers are also not refunded. If the goods are not returned in good condition, we will charge you for the loss in value incurred.

If the goods are returned in good condition, the full price paid will be refunded to the customer by credit entry after examination of the goods. A discount is always granted on the payment method used at the time of purchase. In the case of possible discounts from purchases on account, we will refund the amount by transfer to the corresponding bank account.
